Forms You Need For Responding To The Court If Your Ex-Partner Has Started Divorce Proceedings By Submitting A Sole Divorce Application Form D8.
There are 3 government forms you may need to reply to the court once your ex-partner has submitted a sole divorce application form D8. They are –
BOX 1 – Form D10 is the acknowledgement of service form for you to complete and return to the court within 14 days if you are returning it online or by post. If your solicitor is returning it they must also return it within 14 days.
BOX 2 – Form D8B is called an answer form. It is the form used to reply to the court if you have legal reasons why you DO NOT agree with your ex-partners sole divorce application. This form has a fee, therefore you may need the form in box 3 below to help you with the fee.
BOX 3 – Form B is completed if you as the respondent want the court to take your financial position after the divorce into consideration before finalising the divorce. Form B is sent alongside form D10 to the court.
BOX 4 – Form C8 is the form in which your write your contact details instead of form D10. You will need to leave the contact details section blank in form D10. Form C8 will give the court your contact details and inform them that you want to keep your contact details confidential from your ex-partner or the other party. Form C8 is sent alongside form D10 to the court.
BOX 5 – Form EX160 is the form used by individuals who are on a low income or on certain benefits. This form will allow them to apply for help with their court form fees. Once completed and evidence of benefits and bank statements are attached, form EX160 can be sent along with any other court form where a fee is payable. The court will then assess whether your fees will be paid for you. You can also apply online in advance and get a ‘help with fees’ reference number starting with HWF to write in the relevant box on the form you are asking for help with.
