a property from one party to another
WHAT IS FORM TR1 USED FOR?
Form TR1 is used to transfer the WHOLE of a registered property in one or more names. This form can be used to also transfer an unregistered property which is to be registered for the first time.
If you would like to transfer PART of a registered property, then you will need to complete form TP1.

WHAT IS THE FEE TO SEND FORM TR1 TO THE COURT AND HOW TO PAY FOR IT?
There are fees to send this form to the land registry.
HOW TO COMPLETE FORM TR1 AND WHERE TO SEND IT.
- NOTE 1 – The spouse/ex-partner transferring the property is called the transferor. The spouse/ex-partner the property is being transferred to is called the transferee.
- NOTE 2 – You can complete this form online and then print a hard copy. Alternatively you can download it, print it and then complete by black pen.
- NOTE 3- If you find there is not enough space to complete your answers on your form then please use a government continuation sheet (form CS) to complete your answers and then attach this sheet to your form TR1. Please click on the link below.
- NOTE 4 – Please keep a copy of your form TR1, all evidence, attachments and other forms for yourself outside of the one you send to the land registry.

- Before you complete your form TR1 you will need to do the 5 following things –
- 1 – You will need to know if the property that is being transferred is registered or not. To find out, you will need to do a government search for property information. There is a small fee to get this information and you can do it online.

- 2 – If the property is registered you must then check for any entries in the register such as any restrictions, notices, cautions, clauses in the lease on the property first. If the property is mortgaged you may need to seek the consent of the lender first. Sort these out before applying for a transfer.
- 3 – If your property is registered, you will need to complete form AP1 and send it with your form TR1. If your property is not registered, you will need to complete form FR1.

- 4 – You must also complete a certificate of identity if your transfer is NOT being done by a professional conveyancer. To do this you will need to complete form ID1. All transferees mentioned in part 5 will need to do this. If the transferor is not legally represented then they will also need to complete form ID1. There is a government video to help you.

- 5 – You must find out if you will need to pay stamp duty. If you do you will need to get hold of a stamp duty land tax certificate.

- Part 1 on page 1 of form TR1 will ask you to write the title number of the property in the space provided. The UK land registry holds ‘property information’ on every property or land that is registered with them. To complete form TR1, it is better to order a copy of the property information – you can order these for a nominal fee. The property information is comprised of three things –
- The title register – information about who owns the property.
- The title number – the land registry number of the property.
- The title plan – information about where the property is located and its boundaries.
- Part 2 will ask you to write the full address of the property.
- Part 3 is asking you not to put the date of completion until the transfer has been executed. This means that a document should not be dated until everyone that is required to sign the form, including witnesses if needed, have done so.
- Part 4 will ask you to write the name of the transferors in the space provided. The name must match the name on the register. If the name does not match the name on the register you must provided evidence why this is the case e.g. name change because of marriage or deed poll. If one of the registered owners has died then you will need to provide a death certificate. An executor (a person who can legally act on behalf of another person) can also write their name here.
- Part 5 will ask you to write the name of the transferee(s) in the space provided. You must include the names of ALL the people to whom the property is to be transferred (up to a maximum of 4 people). If a person is transferring part of their property to others, they must include themselves in the transferee section as they will still own part of the property once transferred. Include the title of these persons except the title MR or MRS.
- Part 6 will ask you to write up to 3 addresses (one of which must be a postal address) for each transferee for service for entry on the register.
- Part 8 is asking about the transfer and money. If the transfer is for money please put a cross in the first box and write the amount. If the transfer is a gift then put a cross in the second box. If the transfer is for any other reason please put a cross in the third box and give information as required.
- Part 9 is asking whether the transferor is transferring the full title guarantee or limited title guarantee. A full title guarantee will mean that the transferor guarantees that there are no financial charges, mortgages or third party interest that affect the property other than those already disclosed to the transferee. A limited title guarantee means there is a financial charge, mortgage or third party interest in the property. Please put a cross in the relevant box.
- Part 10 is to be completed if there is more than one transferee. Please put a cross in the relevant box and provide the information necessary.
- Part 11 will ask you to add any additional provisions such as required or permitted statements, certificate or application and any agreed covenants and declarations between the transferor and transferee.
- Part 12 will ask the transferor to execute (legally sign) the transfer. Each transferee must date and sign form TR1 on front of a witness. If parts 10 and 11 have been completed then all the transferees must do the same. A witness must be independent of all concerned and can witness more than one signature. They must sign below each signature they witness. One party to the transfer cannot witness the signature of another party to the transfer. The words used are as follows
Signed as a deed by (full name of the transferor) __________________ (signature)
In the presence of _____________________ (signature of witness). You must print full name and address of witness.
- Please remember you must send the following documents with your form TR1 – they are form ID1, form AP1 or FR1, any evidence for your answers and a stamp duty land tax certificate if you are paying stamp duty.
