WHAT IS FORM FL401T USED FOR?
Form FL401T is a government template used to write a supporting statement.
This supporting statement is attached to form FL401 which is the application form used to apply for a non-molestation or occupation order.
Form Fl401T supporting statement is only used for form FL401 and no other form.

You can either use form FL401T template to write your supporting statement or alternatively if you wish to you can write your own witness statement from scratch and attach it to your form FL401. Both will do. If you decide not to use form FL401T and write your own witness statement you must include a statement of truth as well as your signature and the date.

Please note forms FL401 and FL401T are used when an application for a non-molestation or occupation order is made by hardcopy/paper copy to the court by post or email. If you use the online tool called COURTNAV to make an application for a non-molestation or occupation order then you do not need to use forms FL401 and FL401T. COURTNAV will complete both for you. WHAT IS THE FEE TO SEND FORM FL401T TO THE COURT AND HOW TO PAY FOR IT?
There is no fee to send form FL401T to the court. It is attached to form FL401.
HOW TO COMPLETE FORM FL401T AND WHERE TO SEND IT.
- NOTE 1 – The ex-partner who initiated the original hearing that is being appealed is the petitioner or applicant. The other ex-partner is the respondent.
- NOTE 2 – You can complete form FL401T online and then print a hard copy. Alternatively you can download it, print it and then complete by black pen.
- NOTE 3- If you find there is not enough space to complete your answers on your form FL401T then please use additional sheets of paper to continue on and attach them to your form. Please write your name, address and question number on the top of your additional sheets of paper.
- NOTE 4 – Please send at least 3-4 copies of your form FL401 and FL401T, any evidence and attachments to the court. The court will distribute the copies accordingly. One copy is required for the court and one for each party in the proceedings.
- NOTE 5 – Please keep a copy of your form FL401 and FL401T, all evidence and attachments for yourself outside of the ones you send to the family court.
- Form FL401T is 19 pages long.
- Please do not include page 1 of form FL401T when submitting the form. It is for guidance only.
- Please also note that the word exhibit in this form refers to evidence.
- The first thing you will be asked for on page 2 is to write your initial(s) and your full surname (A.S Smith) in the first box.
- Next you will be asked to write the number of statements you are making in the next box. If you are only completing one statement then please write 1.
- You must then write the number of exhibits/pieces of evidence you will be attaching to your form FL401T in the next box.
- You will then be asked to write the date when you are completing your form FL401T
- Next please write your full name in the applicant box and the name of the person who the application is against in the respondent box.
- In part 1 – Introduction
- Part 1.1 will ask you to write your first name, middle name and surname is the boxes provided.
- Part 1.2 will you to write your full address. If you have already asked the court in your form FL401 to keep yours and your children’s contact details confidential by completing a form C8 then please do not fill in your address details here – just write ‘my address is confidential. Please also make sure none of your exhibits/evidence that you will/may attach to your form FL401T contains your details. Please cover them with a black marker.
- Part 1.3 – if you are making a non-molestation order then please write the respondents relationship to you in the box (e.g. husband) then write their full name.
- Part 1.4 will ask you whether you are applying for an occupation order. Please tick the relevant box. If you are please continue to answer the questions. If you are not then please go to question 1.6.
- Part 1.5 will ask you to write the address that the occupation order is for.
- Part 1.6 will ask you if you are asking for a without notice (ex-parte) court order and if you are you must detail the reasons in the box provided.
- In part 2 – History of your relationship
- Part 2.1 is asking you from which date have you and the respondent known each other.
- Part 2.2 is asking on which date did you become a couple if applicable.
- Part 2.3 will ask has the respondents behaviour changed since the relationship started or has it always been abusive. Please tick the relevant box. If it has always been abusive then please go to part 2.5.
- Part 2.4 – if you have said that the respondents behaviour has changed since your relationship started in part 2.3 then please write the date when you first noticed the respondents behaviour has changed.
- Part 2.5 lists example of abusive behaviour. Please tick the relevant box that applies to you. An explanation of the different types of abuse is given on the right hand side of the form. You can also click on the link below –

- In part 3 – Most recent incident – if there has not been a specific incident but there is a pattern of abuse then go to part 6.
- Part 3.1 will ask you for the date of the most recent incident.
- Part 3.2 will ask you if the incident has ended or not. Please tick the relevant box.
- Part 3.3 will ask you the date the incident ended if it has.
- Part 3.4 will ask you to write the details about the incident in the box provided.
- Part 3.5 will ask you to describe the impact of this incident on yours and your children’s health, safety and wellbeing.
- Part 3.6 will ask you to write down the details of any witnesses or people you have told about the incident. Include the police or any medical professionals if applicable. You must include evidence such as a police report, medical report or photos.
- In part 4 – First incident – if the most recent incident above was not the first time then please give details here in part 4
- Part 4.1 will ask you the date the first incident happened/started.
- Part 4.2 will ask you the date when the incident ended.
- Part 4.3 will ask you to give details about the first incident in the box provided.
- Part 4.4 will ask you about the impact on yours and your children’s health, safety and wellbeing.
- Part 4.5 will ask you to give details for any witnesses and people you have told. Include the police or medical professionals if this is the case. Please attach any police, medical reports or photos.
- In part 5 – Worst incident
- Part 5.1 will ask you if the worst incident of abuse was, the most recent, the first incident or another incident. If it is another incident then continue to answer the questions in part 5 otherwise go to part 6.
- Part 5.2 will ask you the date the worst incident happened or started on.
- Part 5.3 will ask you the date the worst incident ended on.
- Part 5.4 will ask you to give details of the worst incident.
- Part 5.5 will ask you to give details of the impact of this worst incident on yours and your children’s health, safety and wellbeing.
- Part 5.6 will ask you to give details of any witnesses and people you have told about this worst incident. Include the police or any medical professionals if this is the case. Please attach any police, medical reports or photos.
- In part 6 – Patterns of abuse or other incidents
- Part 6.1 will ask you to give details of other abusive behaviour you would like the court to consider. You can detail pattern of behaviour or controlling behaviour.
- Part 6.2 will ask yo to give details of the impact of these behaviours on yours and your children’s health, safety and wellbeing.
- Part 6.3 will ask you to give details of any witnesses and people you have told. Include the police or any medical professionals if this is the case. Please attach any police, medical reports or photos.
- In part 7 – Occupation order – only complete part 7 if you are applying for an occupation order otherwise go to part 8
- Part 7.1 will ask you what responsibility do you and the respondent have for the relevant home. Please tick the relevant box.
- Part 7.2 will ask you to give details of your housing needs such as being near work, proximity to the children’s schools, number of bedrooms, low income, cannot afford to move.
- Part 7.3 will ask you to give details of the respondents housing needs such as proximity to work, any other places they could stay such as a relative, can they rent elsewhere and why, housing needs for any children they are responsible for.
- Part 7.4 will ask you to give details of what worries you have if this occupation order is not made. Explain the impact on you and the children.
- Part 7.5 if you want the court to make an order that the respondent shall NOT a) live at the same address b) enter or attempt to enter the address c) go within a certain distance of the address d) other. Please tock the appropriate box.
- Part 7.6 will ask you if you want ALL or PARTS of the occupation order to include a power of arrest by the police. If you want parts of the occupation order to have a power of arrest then please give details in the space provided.
- In part 8 – Summary
- Part 8.1 is asking you to write a closing summary and should summarise your reasons for applying. Please include any other information here that the court should take into consideration
- On page 18 you will be asked to sign a statement of truth.
- On page 19 there is an exhibit cover sheet. You can copy this sheet as many times as you want. You must then allocate one cover sheet for each exhibit/piece of evidence that you have.
- As stated above please send at least 3 copies of your form Fl401, all attachments, form FL401T and any other form to the court. You must not serve form FL401, form FL401T, any attachments and any other forms on the respondent. The court will do this.
