WHAT IS FORM HR1 USED FOR?

Form HR1 is used to register a ‘Notice of Home Rights’ on a registered property at the land registry. This is very important for all ex-partners whose marital home is solely owned outright by the other ex-partner. A notice of home rights will prevent your ex-partner from selling or re-mortgaging your marital home and protect your rights to occupy your marital home.

A registered property is one that is listed on the land registry central register detailing who owns the property.

Form HR1 is used to register home rights on a registered property until the court issues a final order/decree absolute. This is a legal document stating your marriage has ended.

Form HR1 is also used to transfer home rights from one registered property to another owned by your ex-partner.

If you have already registered your home rights on a registered property using form HR1 but want to continue living there after the divorce, the court can issue a continuation court order. You can use form HR2 to apply for renewal and send the continuation court order with form HR2 to the land registry.

WHAT IS THE FEE TO SEND FORM HR1 TO THE COURT AND HOW TO PAY FOR IT?

This Help Guide was written on 26-10-2021 and on that date there was no fee to send this form in to the land registry.

HOW TO COMPLETE FORM HR1 AND WHERE TO SEND IT.

Once you have submitted your completed form HR1, the land registry will send a notice of your application to your ex-partner who is the registered owner.

You can only have 1 home rights charge registered against only 1 property/home at any one time with respect to your ex-partner.

• NOTE 1 – If you are completing and sending this form in then you are known as the applicant. The applicant is the person asking for the hone rights.
• NOTE 2 – You can complete this form online and then print a hard copy. Alternatively you can download it, print it and then complete by black pen. 
• NOTE  3- If you find there is not enough space to complete your answers on your form HR1, you can use a government continuation sheet (Form CS) to finish your answers. Attach this sheet to your form HR1.
• NOTE 4 – Please keep a copy of your form HR1 and attachments for yourself outside of the ones you send to the land registry.

• Form HR1 is 3 pages long.
• Part 1 will ask for the name of the borough/local authority that your marital home is in. 
• Part 2 will ask you the write down the title number of the property.  If you need to get the title number of the property, you can get it from the land registry by paying a small fee. You can do this online. Please click the link below. The UK land registry holds ‘property information’ on every property or land that is registered with them. The property information is comprised of three things –
  • • The title register – information about who owns the property.
    • The title number – the land registry number of the property.
    • The title plan – information about where the property is located and its boundaries.

• Part 3 will ask you for the full address including post code and any description such as ‘land adjoining 2 Aracia Avenue’.
• Part 4 will ask you about the fee – please leave blank as currently there is no fee to submit this form.
• Part 5 will ask for your full name.
• Part 6 – please write your name, address, telephone number and electronic/email address. Please leave ‘key number’ blank unless you are a solicitor.
• Part 7 will ask you for up to 3 addresses. On must be a postal address. You can write electronic/email addresses. These addresses will be entered in the register and used for correspondence and sending you a letter (serving you the notice).
• Part 8 will ask you to write down the full name of your ex-partner (husband, wife or civil partner)
• Part 9 will ask you if you have a home rights charge registered against another property in respect of your ex-partner named in part 8. Please complete accordingly.
• Part 10 will ask if you have a court order made under section 33(5) of the family law act 1996. If you do please attach a copy of the court order. If you do not then tick the ‘no’ box. 
• Part 11 states 2 statements that you will be agreeing to when you sign your form HR1 in part 12.
• Part 12 will ask you to sign the form. 
• As a member of the public you must send your completed form HR1 to HM Land Registry Citizen Centre, PO Box 74, Gloucester, GL14 9BB.
