PLEASE NOTE – There are two forms detailed on this website that can be used to inform the court that you have served (given or sent court documents) any other party or witness involved in your court proceedings. These two forms are form FP6 and form FL415. Generally form FL415 can be used when your court case concerns a non-molestation order, occupation order, or forced marriage protection order. Form FP6 can be used for all other proceedings.  

WHAT IS FORM FP6 USED FOR?

Form FP6 is used to inform the court that a person (often the other party in court proceedings or their legal representative) has been sent or given (called SERVED in court language) court paperwork (such as a copy of a completed application form) that require them to be informed, respond, comply with court directions or attend court.

WHAT IS THE FEE TO SEND FORM FP6 TO THE COURT AND HOW TO PAY FOR IT?

There is no fee to submit this form to the court. 

HOW TO COMPLETE FORM FP6 AND WHERE TO SEND IT.

  • NOTE 1 – Please send your completed form and any attachments to the court where your case is being heard.
  • NOTE 2 – You only need to send 1 copy of this form to the court.
  • NOTE 3 – Please remember to keep a copy of your form FP6 and all attachments for yourself outside of the copy you send to the court.
  • NOTE 4 – You can complete this form online and print a hard copy or alternatively print the form and complete it with black pen. 
  • Form FP6 is 4 pages long.
  • On page 1 on the top right hand corner the form will ask you to write the name of the court where your case is being heard and the case number. If your case concerns a child then you will need to write their name under the box where you write your case number.
  • Below you are asked to write the date the court document was served and then the title/description of the court document that was served, for example a divorce application form D8. Under this you will need to write the name of the person who has been served and their position at work if they are the legal representative of the person to be served. Please remember you must attach a copy of the court document that has been served to your form FP6.
  • Then the form will ask you about how you have served the court documents. You must tick the relevant box. The choices you have are –
      • First class post.
      • Delivering at the address given below.
      • By other means permitted by the court.
      • By Document exchange.
      • By Personally handing it – you must write down the name of the person the court documents were handed to. 
  • Now will be asked to write the address where the service took place in the box provided.
  • Now you will be asked whether the person who was served was the applicant, respondent, solicitor or litigation friend and whether the place they were served was their usual residence, last known residence, place of business, principal place of business, principal office of the company or another place. Please tick the relevant box.
  • The next box is asking you to write down the date when your service is deemed to be. This means the following –
      • If you post the court documents by first class post on a Monday, the deemed day of service will be Wednesday – second day after it was posted. You must write down the date it will be on the Wednesday in the space provided. 
      • If you used a document exchange, the deemed day of service will be the second day after the court documents left the exchange.
      • If you are delivering the court documents or leaving them at an address, the deemed day of service will be the day after the documents were delivered or left at the address. 
      • If the court document (except an application form) is served personally after 5pm on a business day (any day except Saturday, Sunday, bank holiday, Christmas Day, and Good Friday) the deemed day of service will be the next business day. 
      • If the court document (except an application form) is served personally on a Saturday, Sunday, bank holiday, Christmas day or Good Friday, the deemed day of service will be the next business day.
  • You will now be asked to date and sign a statement of truth. You will need to tick the box explaining who you are in the proceedings (applicant, respondent, litigation friend or legal representative).
