Form Used To Cancel Existing Home Rights With The Land Registry
If Your Home Is A registered Property

 

WHAT IS FORM HR4 USED FOR?

Form HR4 is used to cancel an existing ‘Notice of Home Rights’ on a registered property at the land registry. 

If you are the person who applied for or renewed the home rights then you can cancel your home rights at any time by completing form HR4.

If your ex-partner has applied for or renewed their home rights against your property you can only cancel their existing home rights if you have the following documents which you will need to attach to your form HR4 – 

  • The court has issued an court order ending the home rights.
  • A final order/decree absolute has been granted by the court – a final order/decree absolute is a legal document stating the marriage has ended.
  • Your ex-partner has passed away and there is a death certificate
  • A letter from your ex-partner detailing that they wish to end their home rights.

Please note the following 2 points for background information –

  • A person will register home rights on a their matrimonial home if the home is owned SOLEY by their ex-partner.  A notice of home rights will prevent your ex-partner from selling or re-mortgaging your home and protect your rights to occupy your home. They cannot ask you to leave or force you out unless they have a occupation order saying so from the court.
  • A registered property is one that is listed on the land registry central register detailing who owns the property.

WHAT IS THE FEE TO SEND FORM HR4 TO THE COURT AND HOW TO PAY FOR IT?

This Help Guide was written on 26-10-2021 and on that date there was no fee to send this form in to the land registry.

HOW TO COMPLETE FORM HR4 AND WHERE TO SEND IT.

Once you have submitted your completed form HR4, the land registry will send a notice of your application to your ex-partner.

  • NOTE 1 – If you are completing and sending this form in then you are known as the applicant. The applicant is the person who is cancelling the home rights.
  • NOTE 2 – You can complete this form online and then print a hard copy. Alternatively you can download it, print it and then complete by black pen. 
  • NOTE  3- If you find there is not enough space to complete your answers on your form then please use a government continuation sheet (Form CS) to finish your answers. Attach this sheet to your form HR4.
  • NOTE 4 – Please keep a copy of your form HR4 and attachments for yourself outside of the ones you send to the land registry.

  • Form HR4 is 2 pages long.
  • Part 1 will ask for the name of the borough/local authority that the marital home is in. 
  • Part 2 will ask you the write down the title number of the property.  If you need to get the title number of the property, you can get it from the land registry by paying a small fee. You can do this online. Please click the link below. The UK land registry holds ‘property information’ on every property or land that is registered with them. The property information is comprised of three things –
      • The title register – information about who owns the property.
      • The title number – the land registry number of the property.
      • The title plan – information about where the property is located and its boundaries.

  • Part 3 will ask you for the full address including post code and any description such as ‘land adjoining 2 Aracia Avenue’.
  • Part 4 will ask you to write down the documents that you are submitting with your form HR4. Please only send certified copies of any documents because they will be destroyed once the land registry have made a copy.
  • Part 5 will ask for your full name.
  • Part 6 – write your name, address, telephone number and email address. Please leave ‘key number’ blank unless you are a solicitor. 
  • Part 7 will ask you about the evidence you are submitting with your form HR4 to support your application. You must tick the relevant box –
      • The spouse who has been granted the home rights has signed the release of home rights box on this form.
      • You have enclosed
        • Original or certified copy of a death certificate of either spouse
        • Official or certified copy of final order/decree absolute/nullity of marriage/order of dissolution/nullity of civil partnership.
        • Official or certified copy of a court order ending home rights.
        • The spouse who has been granted the home rights has given a letter stating they no longer wish to have their home rights.  
      • The previous court order detailing home rights has ended
  • Part 8 states a statement for you to read.
  • Part 9 will ask you – the applicant – to sign and date the form.
  • Underneath part 9 there is a box called ‘release of home rights’. The spouse who has been granted the home rights should sign this if they do not want the home rights they have been granted anymore. Alternatively they can write a written statement/letter detailing this also.
  • As a member of the public you must send your completed form HR4 to HM Land Registry Citizen Centre, PO Box 74, Gloucester, GL14 9BB.
