Form FP244

WHAT IS FORM FP244 USED FOR?

Form FP244 is an application form used to make additional applications within an appeal case, that are in connection with the appeal itself. Form FP244 is used for all applications within appeals that are being heard at the family division of the high court. For any other appeals you will need to use form N244.

WHAT IS THE FEE TO SEND FORM FP244 TO THE COURT AND HOW TO PAY FOR IT? 

Yes, there is a fee. Please refer to government guidance form 200 which lists the fees.

• Please attach a cheque or postal order made payable to HM Courts & Tribunal Service.
• If you are on certain benefits or on a low income you can apply to the court to have your fees paid for you. The form you need is called form EX160. You can complete and submit the form online or download a hardcopy from the government website. You will need to attach proof of your benefits, your income, and/or 3 months bank statements. The government website also has the EX160A guidance notes which you can download and read to help you complete form EX160. You can send the completed form EX160 with all attachments along with your completed form FP244 for the court to consider. Or you could have sent your completed form EX160 to the court in advance and received a ‘help with fees’ reference number starting with HWF to write on the form you are asking help with, in this case, form FP244.

HOW TO COMPLETE FORM FP244 AND WHERE TO SEND IT.

• NOTE 1 – The ex-partner who initiated the original hearing that is being appealed is the petitioner or applicant. The other ex-partner is the respondent. The ex-partner who filed the appeal is called the appellant and the other party is the respondent to the appeal.
• NOTE 2 – If you find you cannot complete your answers in the space provided on your form FP244 you can continue on extra sheets of paper and then attach them. Please remember to write your name, date of birth, appeal reference number and question number at the top of the sheet.
• NOTE 3 – You can complete form FP244 online and then print a hard copy. Alternatively you can download it, print it and then complete by black pen. 
• NOTE 4 – Please send at least 3-4 copies of form FP244 and any attachments to the court. The court will distribute the copies accordingly. One copy is required for the court and one for each party in the proceedings.
• NOTE 5 – Please keep a copy of your form FP244, all evidence and attachments for yourself outside of the ones you send to the court where your appeal is being heard – The Family Division Appeals Office – the address is below.
• Form FP244 is 2 pages long.
• In the top right hand corner of page 1 you must write your HWF reference number, appeal court reference number, appellants name, respondents name and the date.
• Part 1 will ask you for your name or the name of the firm if you are a solicitor.
• Part 2 will ask you who you are in the proceedings – whether you are the appellant, respondent, or other. Please tick the relevant box. 
• Part 3 will ask you what court order are you asking the court to make and why. Please give details in the box provided.
• Part 4 will ask you if you have attached a draft copy of this court order you are applying for. If you have then please tick the relevant box.
• Part 5 will ask how you would like this application dealt with – at a hearing. without a hearing or at a telephone hearing. Please tick the relevant box. You can write in a covering letter any dates you are unavailable to attend a court hearing in the next 6 weeks. 
• Part 6 is asking how long do you think the hearing will last and has this time estimate been agreed by the other parties in the proceedings.
• Part 7 is asking if there are any upcoming hearings that have been listed in connection with the appeal.
• Part 8 and 8a is asking you to give details of who you think should be served with a copy of your application form FP244. 
• Part 9 will ask you what information will you rely on to support your application – an attached witness statement or other evidence. If other then you will be asked to give details in the space provided and continue on separate sheets if required and attach them to your form FP244. Please write your name, date of birth, and appeal reference number at the top of each separate sheet.
• You will then be asked to sign a statement of truth.
• Part 10 will ask you to sign your form FP244 and give the address and contact details where you want the court hearing your appeal to send documents to. 
• As stated above please send at least 3 copies of your form FP244 and all attachments to the court. One copy for the court and one for each party on the proceedings. The court will distribute accordingly and serve the respondent.
• The words ‘to serve the respondent’ means they must receive a copy of your application form and any other relevant court papers that require them to respond, comply with directions or attend court.
